ExamCrack AI ("we", "our", "the platform") provides AI-powered online examination services to organizations and their candidates. This Privacy Policy describes what information we collect, why we collect it, how it is used, and the choices available to you.

1. Information We Collect

  • Account information: name, email address, and role when you create an account or are invited to an organization workspace.
  • Exam data: your answers, responses, scores, and progress for exams you take or administer.
  • Proctoring data: with your prior consent, webcam video and microphone audio captured during proctored exams, along with session activity signals used for integrity monitoring. Recording only starts after you explicitly consent and is limited to the duration of the exam.
  • Technical data: device type, browser, approximate network information, and session identifiers needed to operate the platform securely.
  • Organization data: for administrators - organization profile, branding (logo, colors), exam configuration, and candidate rosters.

2. How We Use Information

  • To operate the platform: deliver exams, score responses, generate reports, and manage workspaces.
  • To protect exam integrity: proctoring footage and activity signals are reviewed to detect and deter cheating.
  • To improve the product: usage analytics are aggregated and de-identified where possible.
  • To communicate: account notifications, exam invitations, and support responses.

3. Legal Basis and Consent (DPDP)

We process personal data in line with the Digital Personal Data Protection Act, 2023 (DPDP Act) of India. Where processing is based on consent - in particular, webcam and microphone recording during proctored exams - we obtain your explicit, informed consent before recording begins. You may withdraw consent at any time; withdrawing consent during a proctored exam may invalidate that attempt for integrity reasons, which will be communicated to you at the time.

4. How We Store and Protect Data

  • Storage: data is stored on secure servers managed by us and our hosting providers.
  • Encryption: data is encrypted in transit (TLS). Proctoring media is stored with access-controlled, time-limited playback links.
  • Access control: only authorized administrators of your organization can view proctoring footage and exam results within their workspace. We do not sell or rent personal data to anyone.
  • Retention: we retain data only as long as needed to operate the platform, fulfill exam integrity requirements, or as required by law. When an organization deletes its workspace, associated data is purged from our systems.

5. Sharing of Information

We do not sell personal data. We share information only:

  • With your organization's administrators, within the scope of their workspace.
  • With service providers who help operate the platform (hosting, email delivery), bound by confidentiality obligations.
  • Where required by law, or to protect the rights, safety, and security of the platform and its users.

6. Your Rights

Under the DPDP Act, you have rights to access, correct, and request erasure of your personal data, subject to reasonable exceptions. To exercise these rights, contact your organization's administrator (for workspace data) or write to us at support@jkey.in.

7. Children

The platform is intended for professional and educational assessment. It is not directed at children below the age of 18. Organizations are responsible for ensuring they have appropriate consent for any candidates they onboard.

8. Changes to This Policy

We may update this policy from time to time. Material changes will be reflected by updating the effective date above and, where significant, by notifying registered users.

Terms of Service

1. Acceptance of Terms

By accessing or using ExamCrack AI, you agree to these Terms of Service. If you use the platform on behalf of an organization, you represent that you have authority to bind that organization.

2. Accounts and Eligibility

  • You must be at least 18 years old to use the platform.
  • You are responsible for safeguarding your login credentials and for all activity under your account.
  • You must provide accurate information and keep it up to date.

3. Organization Workspaces

Organizations receive isolated workspaces. Administrators control their workspace: inviting members, creating exams, configuring branding, and managing candidates. Administrators are responsible for compliance with applicable laws in their use of the platform, including obtaining candidate consents for proctoring.

4. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of applicable law.
  • Attempt to circumvent proctoring, access controls, or security measures.
  • Interfere with, disrupt, or overload the platform or its infrastructure.
  • Upload malicious code, scrape the platform, or probe its systems without authorization.
  • Misrepresent your identity or create accounts for others without authorization.

5. Proctoring and Consent

Exams may include proctoring that records webcam video, microphone audio, and session activity. You will be asked for explicit consent before any recording starts. By taking a proctored exam, you agree that recording and integrity monitoring are necessary for the legitimate purpose of preventing misconduct. Attempts where consent is withdrawn or recording is unavailable may be flagged or invalidated, as communicated at the time of the exam.

6. Intellectual Property

  • Our IP: the platform, including its software, design, and AI question-generation technology, is owned by us and protected by applicable laws. You may not copy, modify, or reverse engineer it.
  • Your IP: you retain ownership of content you upload (questions, exam materials, branding). By uploading, you grant us a limited license to host and process it solely to provide the service to you.

7. AI-Generated Content

Exams may include questions generated by AI models. While we work to maintain quality and accuracy, AI-generated content may occasionally contain errors. Review exam content before high-stakes use, and rely on your own judgment where accuracy is critical.

8. Disclaimers

The platform is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or goodwill, arising from your use of the platform. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate access to the platform for violations of these terms, illegal activity, or where required by law. You may stop using the platform at any time. Organizations may delete their workspace, which triggers deletion of associated data.

11. Changes to These Terms

We may revise these terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of India.
